These Terms of Service ("Terms") govern your use of the Barber Collectives website, online store, Academy, community spaces, and the CollectiveOS platform (collectively, the "Services"). By creating an account, placing an order, or otherwise using the Services, you agree to these Terms.
Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. If you are using the Services on behalf of a business, you represent that you have authority to bind that business.
Accounts
You are responsible for the activity that happens under your account and for keeping your credentials secure. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the Services or other users.
Products and Orders
Product availability, pricing, and promotions may change without notice. We may refuse or cancel any order, including for suspected fraud, pricing errors, export-control issues, or violations of these Terms. Sales tax, shipping, and applicable fees will be displayed at checkout.
Payments and Refunds
Payments are processed by third-party providers. By submitting an order you authorize the charge for the total displayed. Refund eligibility is described in our Returns Policy and any program-specific agreement (for example, the Business Partner Program Agreement). Where a refund is approved, we will issue it to the original payment method.
CollectiveOS and Platform Features
CollectiveOS includes proprietary features such as Builder Mode, Intelligence, the Recommendation Ledger, dashboards, automations, and AI-generated outputs. These features are licensed to you on a limited, revocable, non-exclusive, non-transferable basis for your authorized use of the Services. Platform functionality may evolve, expand, or be deprecated over time.
Acceptable Use
You agree not to misuse the Services. Prohibited conduct is described in our Acceptable Use Policy and includes (without limitation) reverse engineering, scraping at scale, redistributing licensed content, abusing other users, or interfering with platform integrity.
Intellectual Property
All software, content, branding, training materials, templates, workflows, dashboards, and platform architecture are owned by Barber Collectives or its licensors. See the Intellectual Property & Copyright Policy for details. Nothing in these Terms transfers ownership of our intellectual property to you.
Third-Party Services
The Services may link to or integrate with third-party services (payments, shipping, analytics, email, AI providers). We are not responsible for third-party services and your use of them is governed by their own terms.
Disclaimers
The Services are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation, that AI outputs will be accurate, or that any business outcome will be achieved.
Limitation of Liability
To the maximum extent permitted by law, Barber Collectives' aggregate liability arising out of or relating to the Services will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) one hundred U.S. dollars. We will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill.
Indemnification
You agree to indemnify and hold Barber Collectives harmless from claims arising out of your misuse of the Services, your violation of these Terms, or your violation of applicable law or third-party rights.
Termination
You may stop using the Services at any time. We may suspend or terminate your access for material or repeated violations of these Terms, for risk or compliance reasons, or where required by law. Sections that by their nature should survive (intellectual property, disclaimers, limitations of liability, indemnification, dispute resolution) will survive termination.
Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by an updated version number and effective date in the Legal Center. Continued use after an update constitutes acceptance.
Governing Law and Disputes
These Terms are governed by the laws of the jurisdiction in which Barber Collectives is organized, without regard to its conflict-of-laws rules. Any dispute will be resolved in the courts of that jurisdiction, unless an applicable consumer-protection law gives you the right to pursue claims elsewhere.
