TERMS OF SERVICE

These Terms of Service govern use of the BARBER COLLECTIVES™ brand and website ("BARBER COLLECTIVES"), owned and operated by VGR USA LLC.

These Terms of Service ("Terms") govern your access to and use of barbercollectives.com (the "Site") and the purchase of any products or services offered by VGR USA LLC d/b/a Barber Collectives. By using the Site you agree to these Terms.

Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to place an order.

Our Business Model

Barber Collectives is an online-only retailer operated by VGR USA LLC. We do not operate our own warehouse. VGR USA LLC is the merchant of record for every order — the seller on your invoice, the party responsible for support, returns and warranty coordination, and the counterparty to these Terms. Fulfillment is completed by our U.S. supplier and distributor partners, who ship product directly to you from their U.S. warehouses. Regardless of which partner physically ships your order, your contractual relationship for the sale is exclusively with VGR USA LLC d/b/a Barber Collectives.

Products & Pricing

We are a retailer for the brands we carry. Product descriptions, images and pricing are subject to change without notice. We reserve the right to limit quantities, refuse or cancel orders (including orders placed at a price posted in error), and to verify information prior to accepting an order.

Payment

Payments are processed by Shopify Payments and Shop Pay. By submitting payment information you authorize the applicable processor to charge your selected payment method.

Shipping & Risk of Loss

See our Shipping Policy. Title and risk of loss pass to you when your order is delivered to the shipping carrier.

Returns & Warranty

See our Returns & Refunds Policy. Any manufacturer warranty is provided directly by the manufacturer under its own terms; coverage, duration and service processes vary by brand and product. Barber Collectives can assist in coordinating warranty claims with the manufacturer where applicable.

Intellectual Property

All content on the Site — including text, photography, video, logos, the BARBER COLLECTIVES™ name, and the BARBER COLLECTIVES logo — is owned by or licensed to VGR USA LLC and may not be copied or reused without our written permission. BARBER COLLECTIVES™ is a trademark of VGR USA LLC. Third-party brand names and logos remain the property of their respective owners.

Acceptable Use

You agree not to (a) misuse the Site, (b) attempt to gain unauthorized access, (c) scrape or reproduce content at scale, or (d) use the Site for any unlawful purpose.

Disclaimers & Limitation of Liability

The Site and products are provided "as is" to the maximum extent permitted by law. VGR USA LLC d/b/a Barber Collectiveswill not be liable for indirect, incidental, special, or consequential damages arising from your use of the Site or products, except where prohibited by law.

Governing Law

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict of laws principles. Any dispute will be brought in the state or federal courts located in Miami-Dade County, Florida.

Binding Arbitration & Class-Action Waiver

Please read this section carefully — it affects your legal rights. Any dispute, claim or controversy arising out of or relating to these Terms, the Site, or any product or service purchased from Barber Collectives (each, a "Dispute") will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that either party may (a) bring an individual claim in small-claims court where jurisdiction and venue permit, or (b) seek injunctive or equitable relief in court to protect intellectual-property rights. The arbitration will take place in Miami-Dade County, Florida, or by video/telephone, and the arbitrator's award may be entered in any court of competent jurisdiction.

Class-action waiver. You and VGR USA LLC d/b/a Barber Collectives agree that any Dispute will be brought in an individual capacity only, and not as a plaintiff or class member in any purported class, collective, consolidated or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative proceeding.

30-day opt-out. You may opt out of this arbitration agreement by emailing support@barbercollectives.com with the subject line "Arbitration Opt-Out" and your full name, mailing address and order number within 30 days of your first purchase or first acceptance of these Terms, whichever is earlier. Opting out does not affect any other portion of these Terms.

DMCA / Copyright Notices

Barber Collectives complies with the Digital Millennium Copyright Act. If you believe content on the Site infringes your copyright, send a written notice to our designated agent that includes: (1) an electronic or physical signature of the copyright owner or authorized agent; (2) identification of the copyrighted work; (3) identification of the allegedly infringing material and a URL where it can be found; (4) your contact information; (5) a good-faith statement that the use is not authorized; and (6) a statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act.
